Harrison Bergeron Essay Kurt Vonnegutââ¬â¢s fictional society adopted the theories of Social Contract and Social Justice to establish a new social and legal order. The people amended the constitution to attain equality for all. With the amendments, they created laws to make a uniform citizenry out of their people and in the process stripped them of their individuality. These laws were also intended to make them think and act alike which was their idea of equality. As to who is benefited from such extreme version of social control depends on whose viewpoint it was coming from. Despite their unrestricted freedoms no one was ultimately benefited in this kind of system. It was no guarantee of peace and absolute control, as in the case of Harrison. His physical and mental states were no match for the handicaps. Once both powers were unleashed and unrestrained what resulted was a blending and coordination that produced a beautiful symphony of dance and music. It was symbolical of the good things that can happen or that can be achieved if we let our natural gifts, talents and skills work for the common good. There can be unity in diversity and peaceful co-existence may be possible. In a controlled society as this fictional one, there were no norms, values, and culture that may identify them. For norms, values and culture were what will set them apart. This was a robotic society where the norms were that which are forced upon them because of the handicaps some were made to wear. Acceptable norms were absent because the standard (equality) was built into the system. In effect one had a common standard to follow in which to comport oneself, no less and no better that the others. There was only one value that stood, no one was above the other in appearance and in the treatment he gave and he got. Culture should define who and what this society was, but what would make it truly unique? There was nothing neither appealing nor interesting in it because everything went against the natural ways of man. People followed rules not out of their volition. How were they to know the good was turning bad, and worse was turning worst, if something in their brains signaled a censure. This restraint was basically against their good and benefit, but they had no choice but to obey what was programmed in their system. Once, this was a society that had reached the extreme end of the balance with their all-out freedoms and unchecked rights of individuals. The situation had reached unmanageable proportion that they had to resort to dramatic crisis control which brought them to the other extreme end by way of the encroachment on their rights and freedoms. This society took not only the peopleââ¬â¢s freedoms but their right senses as well. In what they figure to be the correct moves to effect change, their agitation towards a freak of nature was alarming, like when ââ¬Å"some things about living werenââ¬â¢t quite right â⬠¦ April not being Springtimeâ⬠(Vonnegut, 1961). Law and society have interchangeable attributes. Law may change a society and society may change the law. In the case of Harrison Bergeron, society had made 3 amendments to their constitution out of desire for and necessity to change. They wanted to regulate and curb freedoms to a comfortable magnitude. The change in the law made this society a strictly tempered one. Lawyers and the legal system do not have a place in this society anymore. The Handicapper General proceeded to punish without trial law breakers. The only crime that can be committed was taking oneââ¬â¢s handicaps off and that did not need investigation and defense. The crime and the criminal are self-evident. The fictional society does not have any direct similarities in todayââ¬â¢s time. However, the inference to the curtailment of freedoms is plenty. When a society does not allow an artist to express his heart in his art, the Harrison Bergerons to criticize the government which should be for, by and of the people, and ease the fear of ordinary citizens, they are the translations of Vonnegutââ¬â¢s transgressions of freedoms in his fictional society. Instead of seeking for equality in the extreme, working with diversity might be the better option.

The paper focussed on the key aspects of ethical dilemma and what are the dire consequences of the same. Ethics implies knowing the difference between what you have a right to do and what is right to do (Potter Stewart). The quote explains the position of ethics in an individualââ¬â¢s life. Harrfnsson who was also related to Sunshine production was carrying on the business. With strength of around 800 non paid reporters, the company operates as a non-profit organization worldwide. The company is involved in publishing secret and insight news to the public of the nation. The reason for the same is that the public should be aware of what is happening in their country and what the government is trying to do for the people in reality. Wikileaks has affected the rights of the government in a good manner. The company shows a transparency of news to the public due to which the government is hampered in support manner. Some people on reading the truth and news about the government leave support on the voting rights and are against the government. In the essay below we shall discuss with certain examples how the votes of the government are affected and the legality of wiki leaks from the government point of view and what the overall impact is. The news and transparency of wiki leaks harm the government and support as it is seen that In Kenya during elections in2007 wiki leaks had exposed a government scam of $3,000,000,000 where the scam had resulted to increase in the disease malaria which resulted in 20% death of children below 5 years and after the scam was exposed the news had turned around about 10% of the votes against the government. The two issues involved are: they should have proper and unhampered information on what the governments are trying to do The information which is a clear part of the business of the government must be properly protected so that it allows discussion and helps in proper and good judgments. There is a certain exception where, just to consider that the government is trying to do a secret project and someone from the wiki leak discovers the same, and the project is such that it may cause some significant losses of life. Hence this information sharing with the public shall be totally defensible as it may also be possible that itââ¬â¢s a major sting operation and the full information has not being obtained by the whistle blower. As for publishing the information may save several lives, but if there has been no whistle blowing or like no harm has been prevented. And the information has been actually created and fixed in such manner to against the public for the government. Or even on a worse consideration the operation or project was actually such to put a strategic operation to actually save certain lives of the people and the information could be a compromised leak and may even back fire. SO this manner it harms a lot to the government and it might not prove to be healt hy hence wiki leaks should work in a more refined manner or along with the government so that the support for both are equally mutual. Talking about the liberal rights to the best of my understanding is that the wiki leaks has no authority and permission from the government of the country or any official agreement through which they shall be allowed to share these information to the public or aware the public of the government secret projects of the government. At the same time since every person has rights to freedom and speech it is not anywhere breaking the law and wiki leaks or Assange has also got high support from the reporters and also the general public because via wiki leaks they get to know about news which they shall know or have authority to know being the citizen of that country. Talking about liberal value, then transparency is not only the liberal value but there are other factors also. Value of legitimacy- people who have some public interest should definitely have democratic mandate or some accountability. Legality is another liberal value- the actions that affect others should have some basis in la w. In a liberal society transparency is very important. Privacy to be the third liberal value- in case of the human affairs the people should have the conduct some communication on the basis of confidentiality. If there is no confidence then there shall be no flow of any useful information. Counting on the overall impact is that wiki leaks is at the verge and has public for and against both for them. Though it proves to be very useful and helpful for the general public at the same time it is very harmful or may cause to be very harmful for the government of the country. Wikileaks cal also proves to be a national threat to the country it may harm the peace and harmony of particular countries and their relationships. If Wikileaks had revealed the fact of the US government that the They spent about $300 billion on the war with Afghanistan which was the money of the US taxpayers citizens then the public might react in a negative manner to the government and the other harm would also be that Taliban had been proven stronger than the war of 2001 then this information leak may have resulted to loose credibility of the military troops and the Taliban would have rallied more troops and the war would have been a disaster. So the support of Wikileaks is strong but the overall impact is neutral as there is some information that has to be confidential and wiki leaks may work with the government is such a manner that it shall not hamper the peace and harmony of the country in a negative manner. Ethics when explained is divided into two halves. The first being the descriptive ethics and the other being the prescriptive ethics. The former explains the descriptive behaviours in the ethics whereas the latter explains the normative ethics that is based on the principles of ethics. The descriptive ethics explains about the position of the individual to have a look at the society, their culture, their practices, and might force them to see such number of things as average, height, weight, and other things. These are the things that differentiate people from each other. An Overview Of Critical Legal Studies The given quotation in question is by Robert Gordon, in Law Ideology as featured in Lloyds Introduction to Jurisprudence by MDA Freeman where he has touched upon critical legal studies. For our purposes, my answer will provide a short explanation of what the critical legal studies is about, then it will feature how law maintains inequality according to critical legal scholars, and what techniques are adopted in response to the inequalities and finally how effective these techniques are. Critical legal studies (hereinafter referred to as the CLS) grew out of a dissatisfaction with current legal scholarship.à [2]à As Raymond Wacksà [3]à put it the most important feature of CLS is its rejection of what is taken to be the natural order of things, be it free market or meta-narratives, or the conception of race. Law based on reason is what attract the scholars of CLS the most. For the scholars of CLS it is to doubt the prospect of uncovering a universal foundation of law based on reason. The myth of determinacy is a significant element of the critical assault on law.à [4]à To the scholars of CLS, law is far from being a determinate, coherent body of rules and doctrine, the law is portrayed as uncertain, ambiguous and unstable.à [5]à If American legal realism was jazz jurisprudence, Critical Legal Studies may be its rock successor.à [6]à Ronald Dworkin found the CLS resembling the older movement of American realism, and for him it was too early to decide whether the CLS is more than an anachronistic attempt to make the then dated movement reflower.à [7]à Professor Hilaire McCourbey and Dr. Nigel D. Whiteà [8]à finds the ultimate target for scholars of CLS is to destroy the notion that there is one single truth, and that by disclosing the all-pervasive power structures and hierarchies in the law and legal system, a multitude of other possibilities will be revealed which are all equally valid. LAW, ITS INEQUALITY AND OTHER ISSUES SURROUNDING LAW The scholars of CLS find it very disturbing how the law maintain inequalities in society. According to the scholars of CLS, legal doctrine is limited and imperfect. Legal doctrines can only offer a narrow view of the world. Robert Gordon finds the legal doctrine to comprise of abstract and impoverished categories. These crude, artificial categories e.g., found in criminal law, laws of contract and family, which will illustrated below, are based on complex human relationships although they in no way reflect or naturally represent with what is occurring. With regard to criminal law, M Kelmenà [9]à uses the example of a wife who, having been battered by her husband, kills the husband. Then she pleads the defence of provocation. Question arises whether the judge is to adopt a narrow time frameà [10]à or that of a broad oneà [11]à . No one can say it for sure which law is to be applied here for certain. There may be circumstance where the alleged offender is considered in a narrow time frame basis and another in a broad one. This line of approach is making individuals fall into the contradiction in law faced in criminal law. The law of contract where the principle enshrined in the maxim caveat emptor a maxim devised to protect capitalist interest against the interests of the powerless consumer stands against the principle that it is the function of the state to intervene to protect the weaker party against exploitation is a clear reflection of inequality in law.à [12]à This kind of contradiction in law has always put the judges in confusion as to which principle a judge needs to follow in a given case. It is argued by the scholars of CLS that law is fundamentally political. For D. Kennedyà [13]à there is no line between private and public law. It is a myth.à [14]à There is nothing natural or neutral about contract law as much as administrative law, property law as much as environmental law.à [15]à The law of co-habitation opens range of options to a judge which makes it hardly possible to come to a decision which ultimately causes conflicting outcomes from the courts of law. Where a woman who seeks to enforce a co-habitation agreement against a male partner the question that comes before the court is to choose between (1) common law principle that such agreements are not legally enforceable because of the presumption that such agreements lack the necessary element of an intention to create legal relations and (2) the principle, arising from public policy that it is the duty of the courts to give effect to the intention of the parties. This has always put judges in a difficult position as said earlier. For Peter Gabel,à [16]à one is never, or almost never, a person; instead, one is successively a husband, a bus passenger, a small businessman, a consumer and so on, in contemporary capitalist society. To Mark Kelman,à [17]à liberalism in the eyes of Crits is a system of thought that is simultaneously beset by internal contradiction and by systematic repression of the presence of these contradictions. Liberalism focuses upon individualism and self-interest at the cost of others. The scholars of CLS are against such notion. Such preference is evinced in the laws creation and maintenance of division between the public and private matters. Mills liberty is the perfect example. Mills liberty is the principle that an individual can be compelled where his actions harm others, but must be free where his actions affect himself. The courts always find it difficult to prevent oppression in the private realm because of the legal division between public matters, in which the state or its laws can intervene, and private matters, in which they cannot. The Crits of CLS termed this division as false and a mere illusion. Robert Gordon very clearly mentions that for the Crits, law is inherently neither a ruling-class game plan nor a repository of noble with perverted principles. To Gordon, it is a plastic medium of discourse that subtly conditions how we experience social life.à [18]à Robert Gordon refers to some basic points that the Critics want to make about legal discourse. He refers to discourses of power. Law cannot be a toy for the powerful to play with. However, in reality to avail legal services or matters in conjunction to it one has to be able to wield legal discourses with facility and authority or to pay others, such as lawyers, legislators, lobbyists, etc., to wield them on your behalf is what matters and that is what is takes to posses power in society. For this reason legal discourses tend to reflect the interests and the perspectives of the powerful people who make most use of them.à [19]à This may be regarded as another example of how law maintains inequality in the eyes of the scholars of CLS. However, whether actually being used by the powerful or the powerless, legal discourses are saturated with other non-legal discourses that for the most part rationalise and justify in subtle ways the existing social order as natural necessary and just. à [20]à It is a common phenomenon to make laws to spur economic competitions and thus assisting the elite class in their search for power and wealth. Duncan Kennedyà [21]à mentions that the primary targets in Legal Education are the unhealthy hierarchies at various levels like those existing between lecturers and the students they teach; those between the faculty members and the administrative support and he terms them all as false and unnecessary hierarchy which gets into the mind of law students and thus creates a continual chain of hierarchies. TECHNIQUES APPLIED TO LEGAL DISCOURSES Trashing or Debunking As McCourbey and White put it trashing is mainly aimed at revealing the illegitimate hierarchies that exist within the law and society in general.à [22]à The scholars of CLS are essentially engaged in revealing those hierarchies and undermine them. In Marxism the hierarchy of power exist in terms of classes but he we have seen the hierarchy to exist even in universities where there is a power relationship between lecturer and student.à [23]à It is much more complex than the marxists view.à [24]à Trashing involves seeking to question and challenge the mainstream liberal legal regime. Mark Kelmans scepticism towards mainstream or orthodox views of law led to defend trashing against mainstream academic critics and stated that the discrediting of accepted legal argument is good. The following extract from Kelman explains the purpose of trashing or debunking:à [25]à We are also engaged in an active, transformative anarcho-syndicalist political project At the workplace level, debunking is one part of an explicit effort to level, to reintegrate the communities we live in along explicitly egalitarian lines rather than along the rationalised hierarchical lines that currently integrate them. We are saying: Heres what your teacher did (at you, to you) in contracts or torts. Heres what it was really about. Stripped of the mumbo-jumbo, heres a set of problems we all face, as equals in dealing with work, with politics, and with the world.à [26]à The above quotation reveals the tension of exposing hierarchies at work place, specifically it goes on to mention within the law school and expressly between the teachers and students as discussed earlier. Kelman further mentions that one main objective of trashing is to de-stabilising view of the theoretical world that is trapped in liberal legalism. Trashing helps us to see the underlying complacencies and assumed premises in liberal legalism as imperfect and opposes the belief that the world is running smoothly. Robert Gordon, in his Law Ideology, states that trashing techniques are used sometimes simply to attack the discourses on their own terms to show their premises to be contradictory or incoherent and their conclusions to be arbitrary or based on dubious assumptions or hidden rhetorical tricks.à [27]à He claims that this would reveal the hidden truth of obscure realities. Dereification Dereification is aimed at exposing what the scholars of CLS see as one of the most important functions of law in a liberal society.à [28]à Mostly everyone is in a trapped situation that is to say an implicit hierarchy is established in society. The term employee is attached to people who agree to work for another in return for payment and the term employer is used to refer to the person or body who hires them. The use of employer and/or employee is attached with a range of consequences and expectations for both parties. For this reason the parties are led to behave in a particular way that is to say on the basis of their formalised relation under the heads of employer and employee. In this sense reification has occurred. Peter Gabel has characterised law by reification, which involves a gradual process whereby abstractions, originally tied to concrete situations, are then themselves used and operated instead of the concrete. Dereification involves the scholars of CLS to see it th e other way round. Dereification is basically the recognition and exposure of such fallacies to reveal the law as it really is. Delegitimation To delegitimate law the scholars of the CLS attempt to strip away the veneer of legitimacy to reveal the ideological underpinnings of the legal system.à [29]à McCourbey and White states that delegitimation is aimed at exposing what the scholars see as one of the most important functions of law in a liberal society, namely the legitimation of the socio-economic system of that society. This brings the important insights into the law. Genealogy Robert Gordon considers genealogy as another technique to highlight the awareness of the transitory, problematic and manipulable ways legal discourses divide the world which is by writing their history.à [30]à CONCLUSION CLS is considered as radical by many jurists today. It is submitted that CLS and its technique is to filter the process of thinking of mankind. Most of the general public finds anything more acceptable which brings in more explanation for things going around us in our day to day life. CLS and its technique reveal an attempt to bring equality and more thinking into law. Trashing, genealogy, dereification etc. are all well convincing methods of looking into things surrounding our day to day life to find the right reason and hence bring equality in to law. However, it needs to be mentioned as well that too much critical thinking in to anything may not bring the right or convincing result. Anti-values can be classified into the following six categories by ascending order: (1) the act of destroying the earth-of annihilating humankind and all other living organisms; (2) the act of mass killing of people by initiating a war or committing treason; (3) the act of murdering or causing death to a human being; (4) the act of damaging the body of a human being; (5) the act of greatly harming society; (6) all other crimes not covered by the above. Higher values can be classified into the following five categories in descending rank: (1) absolute values such as absolute truth, absolute goodness, absolute beauty and absolute holiness; (2) the act of contributing to the development and happiness of humankind; (3) the act of contributing to the nation or the state; (4) the act of contributing to the regional society; (5) the act of cultivating oneself and managing one's family well. Generally, people tend to pursue happiness more eagerly than goodness, but because goodness is the higher value than happiness, we ought to pursue goodness more eagerly. In helping people to get the right sense of values and to internalize it, education and enlightenment of citizens based on the guidance of conscience rather than compulsion will be highly effective. 1. Creation Versus Evolution ââ¬Å"Creation Versus Evolution.â⬠Whatââ¬â¢s wrong with this title? Read it to yourself a few times, and then answer that question. Weââ¬â¢ve all heard of the argument. Creationism, the idea that God created all the species as they appear today, versus Evolutionism, the idea that all life evolved from simple bacteria to all the species that appear today, is a familiar controversy. Ever since Darwin first published the Theory of Evolution in his controversial 1859 book The Origin of Species, the debate has raged between religion and science. But this debate is something that has always puzzled me. From the time I first understood what the Theory of Evolution was really saying, I found it difficult to reject. Scientifically, every shred of evidence in biology and genetics I have ever seen points to it, directly or indirectly. And religiously ââ¬â Evolutionism does not contradict Creationism. Evolution is based on two underlying principles that themselves are not at all controversial: heredity and natural selection. Heredity is the principle that organisms pass on different combinations of their traits to their offspring. If an organism has strong traits that help it to survive, then its offspring are likely to possess some of those same strong traits and themselves be more likely to survive. The second principle is natural selection, better known as ââ¬Å"survival of the fittest.â⬠According to natural selection, the organisms with strong, ââ¬Å"fitâ⬠traits are more likely to survive long enough to reproduce than are the organisms with weak, ââ¬Å"unfitâ⬠traits; thus over time, the strong organisms (as a species, or subspecies) will survive and the weak ones will die out. In this way, only the strong traits that help organisms to survive will be preserved over long periods of time. For instance, all the long-necked giraffes that were able to reach foo d in tall trees were able to survive, while all the short-necked ones werenââ¬â¢t able to compete and died out. These two principles, taken alone, are not controversial. Most people seem to intuitively accept them as being true, because they make so much sense and because there is so much scientific evidence to back them up. However, when they are combined together in the Theory of Evolution, something happens. The assertion is made that, over time, species engaging in natural selection and passing on thei... ...y displaces or precludes that same faith. To react with such fear and narrow-mindedness to this ââ¬Å"new-fangledâ⬠idea of Evolution, then, belies a fundamental problem with the Anti-Evolution Creationist viewpoint. These Creationists react with fear to this different way of thinking about the origin of life not because this different way is wrong, but because these Creationists are afraid that they are wrong in their beliefs. Secure Creationists who are confident in their faith have no reason to feel at all threatened by the Theory of Evolution; they are free to embrace it as just another argument for their faith. I believe that it is only the insecure Creationists who are Anti-Evolutionists, because on some level they realize that their faith is weak ââ¬â that maybe their narrow view of things isnââ¬â¢t the only ââ¬Å"right wayâ⬠to look at the world. But, as Comedian Dennis Miller (and any scientist concerned with the truth) would say, ââ¬Å"Thatââ¬â¢s just my opinion. The World was a place where the order of time was non-existent and all of intelligent life's technology was lost for all eternity, all under a veil of turmoil. The more he searched, the less he found. The only sound to be heard was the sound of skulls crushed under foot. Yet his pointless journey continued. He became more frantic; he wanted to find something, a flower, a butterfly, or someone he could socialize with. Still, nothingness was all he found, himself was all he could socialize with. He became scared even though there was nothing to be afraid of. Fear had consumed him, just like fear had consumed The World. He believed too, he would become just a number. However, then he saw it. Pillars of blackness emanating from the horizon, piercing the sky above him, a fair distance away from him. He also saw faint figures, just like himself near the origin of the Pillars, and a city surrounding them. He started walking towards the city. A walk soon turned into run as he was struck with inconsolable relief. He knew, now, he was not the only person in The World. He thought he was alone, but now his fears were all except present. When became closer, inconsolable relief turned to inconsolable pain as he saw the figures close up. He did not see humans, people, or even animals. They were monstrosities. Turned to their state by their own greed and power hungry minds, only mutated organisms were left. One turned and slowly trundled towards him. It wore a long grey unblemished garment, with a hood obscuring its face. Diamonds, gold and other precious materials covered it, in a delicate and intricate pattern. You may not think you know me, however, you know me more than you think you believe, and more than you want to believe.' He was mystified. A figure he had never seen before that claimed to know him. It was too much for him. He started to back down, but then he saw someone behind the figure, someone he recognized. She was talking to someone, a figure just like him. ââ¬ËOrta, you know her do you not? She came here, only recently, to meet her friend. Her friend Vertigo, who knew her, just like I know you.' He was mystified, ââ¬ËIs this a dream, a nightmare?' He thought to himself. The figure stated ââ¬ËThis is not a dream. I am as real as you or Orta.' He was puzzled, being driven to insanity by the information overload. He could not understand what was going on. The area around him had people around him arriving all the time, meeting mysterious figures just like him. ââ¬ËLook around,' the figure continued, ââ¬ËThere is your friend Alambad with Insanity, your doctor Xenia with Death, your cousin Vyse with Paranoia, you are not alone.' He became hysterical, his eyes widening, his face as pale as the moon itself. He ran at his cousin, screaming and shouting. Yet Vyse did not notice him. ââ¬ËYou attempts at communicating with beings other than me are futile. I am the only one you can converse with at The World.' He stopped, with tears in his eyes and dragged himself back to the figure. ââ¬ËWhat is your name?' he asked, as he tried to hide his emotions. When he received no response, he repeated his question louder with more infurity. It replied ââ¬ËThe figure you see before you now, the figure you are conversing with now has no name. It is nothing. It does not exist except inside yourself. However as humans require a name for everything, you may refer to me, as Isolation.' He raised his claw like limbs to lift the hood that covered its face. As the hood fell behind it, he winched in disgust as he saw what the hood was hiding. On his face he had, nothing. ââ¬ËVictims of our own fear brought us here, there is no way out.' Isolation said with his none existent lips. He raised a boney finger towards the pillars of shadow and continued ââ¬ËYou humans fuel The World through your fears and phobias.
